  1. Agreement. The following Terms of Service (the “Terms”) constitute a binding agreement between you and oshiSPARK, LLC. (oshiSPARK,” “we,” “our,” and “us”), the operator of the Akasupa platform (the “Platform”). These Terms set forth conditions regarding your access to and use of the Platform.

    By accessing or using the Platform in any manner, you agree to be bound by these Terms.

  2. Use of Services. By using Akasupa, you agree to allow us to contact you to send you emails about your account, and the purchases you make on the Platform. Payment processing is handled by our third-party payment processor, Stripe. By using Akasupa, you agree to Stripe's terms of service and privacy policy. All items purchased are non-refundable and non-transferable. You may not share your account with anyone else. Refunds will only be issued if an event is cancelled or the Platform is unable to operate during an event. You may also receive emails informing you of other oshiSPARK events that you may be interested in. You can unsubscribe from these emails at any time.

  3. Use of Google and YouTube Services

    Our Platform uses Google/YouTube API Services to provide gated features such as presale registration eligibility verification.

    Data Accessed

    When a user connects their Google account, we access the following Google user information:

    - See, edit, and permanently delete your YouTube videos, ratings, comments and captions. We only use this to see if you can read comments on a specific members-only video, and then discard it.
    - Know who you are on Google and associate you with the personal info you have made public. We use this to store your unique Google account ID, so we can prevent duplicate presale registrations using the same Google account.

    Data Usage

    Google user information is used solely to:

    - Verify eligibility for presale access based on YouTube channel membership
    - Prevent duplicate presale registrations using the same Google account

    The data is processed in real time and is not used for advertising, profiling, or analytics.

    To summarize:

    Utilization: Google and YouTube user information is used solely to verify presale eligibility by confirming YouTube channel membership status. We do this by checking if you can read a comment on a specific video. The information is processed in real time and is not used for advertising, analytics, or profiling.

    Management: Access to Google user information is strictly limited to automated systems and authorized personnel as required to operate the presale verification feature. Access is logged and audited regularly, and the data is handled in accordance with the principle of least privilege.

    Storage: We store only the unique Google Account user ID for users who register for a presale, and only to prevent duplicate registrations. No YouTube comments, membership details, or other Google account data are stored. All temporary verification data is immediately discarded after eligibility determination.

    Data Storage

    We store only the Google Account unique user ID for users who register for a presale. Any account information that is stored in our database (in this case, the user ID of your Google account) is encrypted at rest and in transit, and can only be accessed by a strictly controlled group of oshiSPARK employees for the purposes of maintaining the Platform. All access to user data is logged and audited on a regular basis.

    We do not store:

    - YouTube comments
    - Membership details
    - Video metadata
    - Any other Google account information, other than your unique user ID

    All transient verification data is immediately discarded after eligibility determination.

    Data Sharing

    Google user data is never sold, shared, or disclosed to third parties, service providers, or partners.

    Google user data is accessed only by our Platform and solely for the purposes described above.

    Data Storage & Protection

    Any stored Google user data is protected using industry-standard security practices, including:

    - Encryption at rest and in transit (TLS)
    - Strict access controls limited to authorized personnel
    - Regular auditing and logging of access to user data
    - Principle of least privilege for internal access

    Data Retention & Deletion

    The Google Account user ID is retained only for as long as the user maintains an account on the Platform or participates in presale registration.

    Users may:

    - Delete their Platform account at any time
    - Request deletion of all associated data by contacting [email protected]
    - Upon deletion, all stored Google user identifiers are permanently removed from our systems within 30 days.

    User Consent

    Users who connect their Google or YouTube account agree to be bound by:

    Users may revoke Google account access at any time via their Google Security Settings.

  4. Collection of information. We only collect the information we need to run our services. We do not track you or sell your information to any third party. You can request all data deleted by us at any time by emailing [email protected].

  5. Disclaimer of Warranties. YOU HEREBY ACKNOWLEDGE THAT YOU ARE USING THE PLATFORM AT YOUR OWN RISK. THE PLATFORM IS PROVIDED ”AS IS,“ AND OSHISPARK, ITS AFFILIATES AND ITS THIRD PARTY SERVICE PROVIDERS HEREBY DISCLAIM ANY AND ALL WARRANTIES, EXPRESS AND IMPLIED, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF ACCURACY, RELIABILITY, MERCHANTABILITY, NON-INFRINGEMENT, FITNESS FOR A PARTICULAR PURPOSE, AND ANY OTHER WARRANTY, CONDITION, GUARANTEE OR REPRESENTATION, WHETHER ORAL, IN WRITING OR IN ELECTRONIC FORM. OSHISPARK, ITS AFFILIATES, AND ITS THIRD PARTY SERVICE PROVIDERS DO NOT REPRESENT OR WARRANT THAT ACCESS TO THE PLATFORM WILL BE UNINTERRUPTED OR THAT THERE WILL BE NO FAILURES, ERRORS OR OMISSIONS OR LOSS OF TRANSMITTED INFORMATION, OR THAT NO VIRUSES WILL BE TRANSMITTED THROUGH THE PLATFORM.

    Because some states do not permit disclaimer of implied warranties, you may have additional rights under your local laws.

  6. No Waiver. The failure of oshiSPARK to enforce any right or provision of these Terms will not constitute a waiver of future enforcement of that right or provision.

  7. Assignment. You may not assign or transfer these Terms, by operation of law or otherwise, without oshiSPARK's prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be null and of no effect. oshiSPARK may assign or transfer these Terms, at its sole discretion, without restriction. Subject to the foregoing, these Terms will bind and inure to the benefit of the parties, their successors and permitted assigns. Unless a person or entity is explicitly identified as a third party beneficiary to these Terms, these Terms do not and are not intended to confer any rights or remedies upon any person or entity other than the parties.

  8. Severability. If for any reason an arbitrator or a court of competent jurisdiction finds any provision of these Terms invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the other provisions of these Terms will remain in full force and effect.

  9. Governing Law; Venue. The laws of the State of California, without reference to its choice or law or conflict of law rules or principles, shall govern these Terms and any dispute of any sort that might arise between you and oshiSPARK with respect to these Terms.

  10. Modification. oshiSPARK reserves the right, at its sole discretion, to modify these Terms at any time and without prior notice. The date of the last modification to the Terms will be posted at the beginning of these Terms. It is your responsibility to check from time to time for updates. By continuing to access or use the Platform, you are indicating that you agree to be bound by any modified Terms.

  11. Acceptable Use. oshiSPARK reserves the right, at its sole discretion, to determine that a user has not used the Platform in an acceptable way. oshiSPARK reserves the right to revoke access to the Platform in these cases.

  12. Entire Agreement. These Terms constitute the entire agreement between you and oshiSPARK regarding your use of the Platform, and supersede all prior written or oral agreements.
